1. Introduction and Acceptance

These Terms and Conditions govern purchases from Lunavellearte and use of our website in Hong Kong. By placing an order, you agree to these Terms, subject to rights that cannot lawfully be excluded or restricted. Questions may be sent to aesthetics@lunavellearte.com.

Lunavellearte sells decorative items exclusively within Hong Kong.

2. Applicable Hong Kong Law

Our transactions and website operations are subject, where applicable, to the Sale of Goods Ordinance (Cap. 26), Trade Descriptions Ordinance (Cap. 362), Control of Exemption Clauses Ordinance (Cap. 71), Unconscionable Contracts Ordinance (Cap. 458), Electronic Transactions Ordinance (Cap. 553), and Personal Data (Privacy) Ordinance (Cap. 486).

Nothing in these Terms excludes, restricts, or modifies any statutory consumer right or resolution that cannot legally be excluded.

3. Products and Website Information

We make reasonable efforts to present decorative items accurately, including descriptions and images. Screen settings and lighting may cause reasonable differences in appearance.

Availability may change, and an item may become unavailable before fulfillment. If we cannot fulfill an accepted order, we will communicate with the customer and provide an appropriate resolution consistent with applicable law.

4. Orders and Cash on Delivery

Lunavellearte operates using a Cash on Delivery (COD) model. Customers do not make an online payment when placing an order. The full order amount is payable upon delivery using the payment methods available and communicated to the customer at the time of delivery. Submitting an order requires accurate contact and delivery information. Free shipping applies to eligible orders delivered within Hong Kong.

5. Shipping and Delivery

Lunavellearte delivers exclusively within Hong Kong and provides free shipping.

Our estimated total delivery timeline is 2 to 3 business days, beginning after successful order placement and confirmation. Approximately 1 business day is required to process and ship the product. After shipment, transit generally requires an additional 1 to 2 business days.

Business days exclude Saturdays, Sundays, and Hong Kong public holidays. Delivery estimates may be affected by circumstances reasonably outside our control, including severe weather, transportation disruption, incorrect delivery information, or other operational interruptions.

6. Thirty Day Return Policy

Lunavellearte provides a 30 day return period beginning on the date the customer receives the product. Under our voluntary return policy, returns are accepted for products delivered damaged or when the customer receives an incorrect product. Returns based solely on change of mind are not accepted.

Eligibility requirements, return procedures, doorstep collection, inspection, exchanges, refunds, and applicable time-frames are explained in our separate Return and Refund Policy. Nothing in our voluntary return policy excludes or restricts statutory consumer rights or solutions that cannot lawfully be excluded under Hong Kong law.

7. Exchanges and Refunds

Where a damaged or incorrect product qualifies for a return under our Return and Refund Policy, Lunavellearte will provide an exchange when the appropriate replacement is available. If the appropriate replacement is unavailable, an accepted refund will be initiated through bank transfer.

8. Customer Responsibilities

Any damaged or incorrect item should be reported promptly within the thirty day return period.

Customers must not misuse the website, submit fraudulent orders, interfere with website operation, impersonate another person, or use our content or services for unlawful purposes.

9. Intellectual Property and Website Use

Website text, graphics, branding, photographs, layouts, and other content owned by or patented to Lunavellearte are protected by applicable intellectual property laws. Unauthorized reproduction, distribution, modification, or commercial exploitation is prohibited to the extent permitted by law.

10. Liability and Statutory Rights

Nothing in these Terms attempts to exclude liability where exclusion is prohibited by law. Any limitation or exclusion of liability applies only to the extent lawful and reasonable under applicable Hong Kong legislation, including the Control of Exemption Clauses Ordinance.

Customers retain applicable rights concerning goods that do not correspond with description, are defective, or otherwise fail to meet legally implied requirements under the Sale of Goods Ordinance.

11. Privacy

Personal data collected through orders, customer communications, and website interactions is handled according to our Privacy Policy and the Personal Data (Privacy) Ordinance (Cap. 486). Customers should review our Privacy Policy for information regarding collection, use, retention, disclosure, security, and applicable data rights.

12. Changes to These Terms

Lunavellearte may update these Terms when reasonably necessary to reflect legal, operational, or business changes. Updated Terms will be published on our website. Changes will not retrospectively remove accrued statutory rights or resolutions relating to completed transactions.

These Terms and disputes arising from transactions with Lunavellearte are governed by Hong Kong law and subject to the jurisdiction of the competent Hong Kong courts. Nothing in this section prevents a customer from pursuing any complaint, solution, or dispute resolution avenue available under applicable law.
